Agreement between User and Anne Roos Smink

 

Rights to Artwork and Images

All artwork, images, and graphics are the sole property of Anne Roos Smink and may not be used by any third party without written permission. Copying or reproducing artwork created by Anne Roos Smink (as seen on anneroosart.com, or elsewhere) is strictly prohibited without written permission from the artist.

Anne Roos Smink retains all rights to all artwork until it has been purchased by a private or public collector at which time the collector receives the right to display the artwork in their home or business. Anne Roos Smink retains all rights to the image of all artwork including the rights to the image of sold & commissioned original paintings. Anne Roos Smink retains the right to make reproductions of any and all artwork created by Anne Roos Smink unless the collector has purchased the full or partial rights to the artwork in addition to purchasing the original painting.

Collectors of reproductions have the right to display the artwork in their home or business but retain no other rights to the artwork.

Any image of the interior which includes the artwork in a 3rd party publication (such as social media, magazine, or book) must come with attribution (artwork title, artists name). All other uses must be agreed to in advance in writing.

 

Shipping/return policies

Original artworks
All sales of original pieces and prints are final and non refundable. Exceptions are made in case of damage or loss incurred whilst shipping.

Workshops
You may cancel your order within the first 24 hours. Returns and exchanges are handled on a case by case basis.

Ordering
On placing an order you will receive a confirmation email acknowledging receipt of your purchase. Your order will be shipped within 3 working days. Goods purchased from the website are for personal use only and should not be used for marketing or promotional use except by the artist.

Loss/Damage
If damage has occurred, please contact me within 7 days of receiving your parcel. Regarding package loss, please contact me within 7 days after your expected shipping time based on your location. Please see the Shipping & Return page for estimated shipping times and what to do if your package doesn’t arrive when expected. Please retain all packaging as photos are needed for insurance. For insurance purposes a minimum of 3 well lit, detailed photographs of said damage to the parcel and the packaging are required. If there are any issues it is recommended 6 photos are provided which detail all damages. If you are unable to provide detailed images of the damage, it will not be possible to move forward on a refund.

Payment and Pricing
Payments for orders made from the shop are accepted via Stripe.com. Cheques or postal orders are not accepted. Prices are displayed in Euro (EUR). For customers whose method of payment is in a currency other than EUR, then orders will be subject to the exchange rate on the day of the transaction. This will be converted live when you click to complete your purchase.

Shipping
For information and shipping costs, please click on the Shipping & Returns page. Worldwide shipping is available – shipping costs are calculated when you select your delivery country at the checkout. Shipping charges include packaging and handling costs, and are based on the dimensions and price of your artwork.

Custom charges

Customers are responsible for any customs charges, if applicable. Please contact your local customs office prior to purchase for more details on duties, taxes and fees according to your countries regulations.

Shipping Address
Please ensure your Shipping Address is correct at the time of purchase. Any postage paid on orders returned to us due to errors in your Shipping Address will be invoiced to you before the order can be shipped again.

Delayed Post
Please take into account that shipping may be delayed because of the current situation (COVID19 related delays) and during busier times of the year, such as Christmas. We are not responsible for any delays but will try and provide information on delayed packages when available. We are not liable for any mishandling or failed delivery by the shipping service. Please note that international shipping that needs to be cleared at customs can take up to 6 weeks at certain times of the year. Until they clear customs they are technically not “delivered” to the country they are shipping too. Once they clear customs they are officially part of that countries postal service and tracking will resume as normal. Should you have any concerns, please get in touch. Original Art Care
Each piece of original art has been carefully sealed with a protective UV varnish spray. However to best preserve the vibrancy of colour and to avoid any possible colour fading over time it is recommended all original artworks are kept out of direct sunlight and where possible displayed behind UV protective glass. If you have any questions regarding the care of your artwork please contact me.

Changes to Terms
Anne Roos Smink reserves the right, in its sole discretion, to change the Terms under which this website is offered. The most current version of the Terms will supersede all previous versions.

Law

Dutch law applies to these terms & conditions.
